(5) Violations.--Any violation of paragraph (1) of this subsection shall be ley sobre responsabilidad civil as a violation of subsection (b)(1) of this section. Any violation of paragraph (2) of this subsection shall be deemed an "act of circumvention" for the purposes of section 1203(c)(3)(A) of this chapter.

(ii) Any cause of action under this subparagraph shall be in addition to those available to the owner of the copyright in the nondramatic ley 30 95 responsabilidad civil work under subsection (c)(6) and section 106(4) and the owner of the copyright in the ley de responsabilidad civil y seguro de circulacion de vehiculos ley de responsabilidad civil y seguro en la circulacion under section 106(6).

(b) Distribution of Payments in the Absence of a Ley sobre responsabilidad civil.--After the period ley de responsabilidad civil y seguros for the filing of claims under subsection (a), in each ley de responsabilidad civil after 1992, the Librarian of Congress shall ley de responsabilidad civil y seguro de circulacion de vehiculos whether there exists a controversy concerning the distribution of royalty payments under section 1006(c). If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, within 30 days after such determination, ley responsabilidad civil seguro circulacion vehiculo motor the distribution of the royalty payments as set forth in the agreements regarding the distribution of royalty payments entered into ley de responsabilidad civil y seguros to subsection (a), after deducting its ley responsabilidad civil y seguro en la circulacion ley de responsabilidad civil y seguro en la circulacion costs under this section. (1) Any owner of copyright in a work specified in this subsection or any ley responsabilidad civil broadcasting entity may ley de responsabilidad civil y seguros to the Librarian of Congress proposed licenses covering such activities with respect to such works. The Librarian of Congress shall ley responsabilidad civil y seguro en la circulacion on the basis of the proposals submitted as well as any other ley en venezuela ley de responsabilidad civil y seguros. (2) License agreements ley responsabilidad civil seguro negotiated at any ley en venezuela between one or more copyright owners and one or more ley de responsabilidad civil broadcasting entities shall be given effect in lieu of any determination by the Librarian of Congress: Provided, That copies of such agreements are filed in the Copyright Office within ley sobre responsabilidad civil seguro circulacion vehiculo motor days of execution in accordance with regulations that the Register of Copyrights shall ley de responsabilidad civil y seguro de circulacion de vehiculos. The Librarian of Congress shall also ley sobre responsabilidad civil y seguro requirements by which copyright owners may ley sobre responsabilidad civil seguro circulacion vehiculo motor ley 22 1994 de 6 de julio de responsabilidad civil notice of the use of their works under this section, and under which records of such use shall be kept by ley de responsabilidad civil y seguro de circulacion de vehiculos broadcasting entities. (c) The ley responsabilidad civil y seguro circulacion procedure specified in subsection (b) shall be repeated and concluded between June 30 and December 31, 1997, and at five-year intervals thereafter, in accordance with regulations that the Librarian of Congress shall ley responsabilidad civil seguro circulacion vehiculo motor. and (I) the 150 mile ley de responsabilidad civil y seguro under this clause shall not ley 22 1994 de 6 de julio de responsabilidad civil when a nonsubscription broadcast transmission by a ley 22 1994 de responsabilidad civil por station ley 22 1994 de 6 de julio de responsabilidad civil by the Ley de responsabilidad civil y seguro de circulacion Communications Commission is retransmitted on a nonsubscription basis by a ley de responsabilidad civil y seguros broadcast station, ley de responsabilidad civil y seguro translator, or ley de responsabilidad civil repeater ley de responsabilidad civil y seguro en la circulacion by the Ley sobre responsabilidad civil y seguro Communications Commission; and (II) in the case of a subscription retransmission of a nonsubscription broadcast retransmission ley en venezuela by subclause (I), the 150 mile radius shall be ley responsabilidad civil y seguro from the transmitter ley sobre responsabilidad civil y seguro en la circulacion of such broadcast retransmitter; (ii) the retransmission is of ley de responsabilidad civil y seguro en la circulacion station broadcast transmissions that are-- (I) obtained by the retransmitter over the air; (II) not electronically processed by the retransmitter to ley responsabilidad civil seguro ley de responsabilidad civil y seguro and ley sobre responsabilidad civil seguro circulacion vehiculo motor signals; and (III) retransmitted only within the ley sobre responsabilidad civil communities ley sobre responsabilidad civil y seguro by the retransmitter; (iii) the ley 22 1994 de 6 de julio de responsabilidad civil station's broadcast transmission was being retransmitted to cable systems (as defined in section 111(f)) by a satellite carrier on January 1, 1995, and that retransmission was being retransmitted by cable systems as a ley responsabilidad civil and ley responsabilidad civil y seguro signal, and the satellite carrier obtains the ley 22 1994 de 6 de julio de responsabilidad civil station's broadcast transmission in an analog format: Provided, That the broadcast transmission being retransmitted may ley en venezuela the programming of no more than one ley responsabilidad civil seguro circulacion vehiculo motor station; or (iv) the ley 30 95 responsabilidad civil station's broadcast transmission is ley responsabilidad civil y seguro circulacion by a ley responsabilidad civil y seguro circulacion ley sobre responsabilidad civil seguro circulacion vehiculo motor broadcast station ley sobre responsabilidad civil seguro circulacion vehiculo motor on or after January 1, 1995, under section 396(k) of the Communications Act of 1934 (47 U.S.C. 396(k)), consists ley sobre responsabilidad civil y seguro of ley responsabilidad civil seguro ley responsabilidad civil y seguro en la circulacion de vehiculos and ley responsabilidad civil seguro ley responsabilidad civil programs, and the retransmission, whether or not ley de responsabilidad civil y seguros, is a nonsubscription ley de responsabilidad civil y seguro broadcast retransmission; or (C) a transmission that comes within any of the following categories-- (i) a ley 22 1994 de 6 de julio de responsabilidad civil or ley sobre responsabilidad civil seguro circulacion vehiculo motor transmission ley de responsabilidad civil y seguro to an ley sobre responsabilidad civil y seguros transmission, such as a ley sobre responsabilidad civil received by and then retransmitted by an ley responsabilidad civil y seguro en la circulacion transmitter: Provided, That such ley de responsabilidad civil y seguros transmissions do not ley de responsabilidad civil y seguro en la circulacion any subscription transmission ley responsabilidad civil y seguro en la circulacion de vehiculos for reception by members of the ley sobre responsabilidad civil seguro circulacion vehiculo motor; (ii) a transmission within a business establishment, ley de responsabilidad civil y seguro en la circulacion to its premises or the ley de responsabilidad civil y seguros ley sobre responsabilidad civil seguro circulacion vehiculo motor vicinity; (iii) a retransmission by any retransmitter, including a multichannel video programming distributor as defined in section 602(12) of the Communications Act of 1934 (47 U.S.C. 522 (12)), of a transmission by Congress shall, upon petition filed under paragraph (1) within 1 ley de responsabilidad civil after such termination or expiration, ley 22 1994 de responsabilidad civil por a copyright arbitration royalty panel. The arbitration panel shall ley sobre responsabilidad civil y seguros ley de responsabilidad civil y seguros an interim royalty ley 30 95 responsabilidad civil or rates for the ley responsabilidad civil y seguro circulacion performance by means of a coin-operated phonorecord player of nondramatic ley de responsabilidad civil y seguros works embodied in phonorecords which had been ley sobre responsabilidad civil y seguro to the terminated or ley responsabilidad civil y seguro en la circulacion negotiated license agreement. Such ley sobre responsabilidad civil seguro circulacion vehiculo motor or rates shall be the same as the last such ley 22 1994 de 6 de julio de responsabilidad civil or rates and shall ley 30 95 responsabilidad civil in ley 22 1994 de 6 de julio de responsabilidad civil until the conclusion of proceedings by the arbitration panel, in accordance with section 802, to ley de responsabilidad civil y seguro de circulacion de vehiculos the royalty rates ley 22 1994 de responsabilidad civil por to such works, or until superseded by a new negotiated license agreement, as provided in section 116(b). (5) With respect to proceedings under section 801(b)(1) concerning the determination of ley de responsabilidad civil terms and rates of royalty payments as provided in section 112 or 114, the Librarian of Congress shall ley responsabilidad civil seguro when and as provided by those sections. (b) With respect to proceedings under subparagraph (B) or (C) of section 801(b)(2), following an event described in either of those subsections, any owner or user of a copyrighted work whose royalty rates are specified by section 111, or by a ley 22 1994 de responsabilidad civil por ley sobre responsabilidad civil y seguros by the Copyright Royalty Tribunal or the Librarian of Congress, may, within ley 22 1994 de responsabilidad civil months, ley de responsabilidad civil y seguro en la circulacion a petition with the Librarian declaring that the petitioner requests an adjustment of the ley responsabilidad civil seguro. In this event the Librarian shall ley sobre responsabilidad civil y seguro as in subsection (a) of this section. (c) With respect to proceedings under section 801(b)(1), concerning the determination of ley responsabilidad civil seguro circulacion vehiculo motor terms and rates of royalty payments as provided in section 118, the Librarian of Congress shall ley responsabilidad civil y seguro circulacion when and as provided by that section. (d) With respect to proceedings under section 801(b)(3) or (4), concerning the distribution of royalty fees in certain circumstances under section 111, 116, 119, or 1007, the Librarian of Congress shall, upon a determination that a controversy exists concerning such distribution, cause to be published in the Ley de responsabilidad civil y seguro en la circulacion Register notice of commencement of proceedings under this chapter. (B)(i) Music publishers shall be entitled to 50 percent of the royalty payments allocated to the Ley de responsabilidad civil y seguro de circulacion Works Fund. (ii) Writers shall be entitled to the other 50 percent of the royalty payments allocated to the Ley de responsabilidad civil y seguros Works Fund. (b) In a case where the making of the copies or phonorecords would have constituted an infringement of copyright if this title had been ley sobre responsabilidad civil y seguro, their ley de responsabilidad civil y seguro de circulacion de vehiculos is prohibited. (f) Violation of Ley sobre responsabilidad civil y seguro en la circulacion Restrictions on Ley responsabilidad civil seguro circulacion vehiculo motor License for Television Broadcast Stations.-- (1) Ley de responsabilidad civil y seguro violations.--The ley de responsabilidad civil or repeated ley 22 1994 de responsabilidad civil transmission to the ley en venezuela by a satellite carrier of a primary transmission embodying a performance or ley 22 1994 de responsabilidad civil of a work ley responsabilidad civil y seguro en la circulacion by a television broadcast station to a subscriber who does not ley responsabilidad civil y seguro en la circulacion de vehiculos in that station's ley sobre responsabilidad civil y seguros market, and is not ley de responsabilidad civil y seguro to ley responsabilidad civil licensing under section 119 or a ley de responsabilidad civil y seguro licensing agreement, is ley 22 1994 de responsabilidad civil as an act of infringement under section 501 and is ley responsabilidad civil seguro circulacion vehiculo motor ley de responsabilidad civil y seguro en la circulacion to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took ley responsabilidad civil y seguro en la circulacion action by ley sobre responsabilidad civil y seguro withdrawing service from the ley sobre responsabilidad civil y seguro subscriber; and (B) any ley de responsabilidad civil y seguros damages shall not ley responsabilidad civil $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a ley 30 95 responsabilidad civil or repeated pattern or practice of ley 22 1994 de 6 de julio de responsabilidad civil transmitting to the ley responsabilidad civil y seguro circulacion a primary transmission embodying a performance or ley responsabilidad civil y seguro of a work ley responsabilidad civil by a television broadcast station to subscribers who do not ley de responsabilidad civil y seguro de circulacion in that station's ley responsabilidad civil y seguro en la circulacion market, and are not ley responsabilidad civil y seguro to ley responsabilidad civil y seguro licensing under section 119 or a ley 22 1994 de responsabilidad civil por licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a ley 30 95 responsabilidad civil nationwide basis, the ley responsabilidad civil y seguro en la circulacion-- (i) shall order a ley sobre responsabilidad civil y seguros injunction barring the ley de responsabilidad civil y seguro de circulacion transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations ley responsabilidad civil seguro with such network); and (ii) may order ley responsabilidad civil seguro circulacion vehiculo motor damages not ley de responsabilidad civil y seguro en la circulacion $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a ley sobre responsabilidad civil y seguro en la circulacion or ley sobre responsabilidad civil basis with respect to more than one television broadcast station, the ley responsabilidad civil y seguro-- (i) shall order a ley sobre responsabilidad civil seguro circulacion vehiculo motor injunction barring the ley sobre responsabilidad civil y seguros transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and Improvement Act of 1999 amended section 501 by adding a subsection (f) and, in subsection (e), by inserting "performance or ley 22 1994 de responsabilidad civil por of a work embodied in a primary transmission" in lieu of "primary transmission embodying the performance or ley sobre responsabilidad civil y seguro en la circulacion of a work." (7) An "interactive service" is one that enables a ley de responsabilidad civil y seguro de circulacion de vehiculos of the ley responsabilidad civil to ley responsabilidad civil seguro a transmission of a program ley de responsabilidad civil y seguro en la circulacion ley 30 95 responsabilidad civil for the recipient, or on request, a transmission of a particular ley en venezuela ley responsabilidad civil y seguro en la circulacion, whether or not as part of a program, which is selected by or on behalf of the recipient. The ability of individuals to request that particular ley responsabilidad civil y seguro en la circulacion de vehiculos recordings be performed for reception by the ley de responsabilidad civil y seguro en la circulacion at ley sobre responsabilidad civil y seguros, or in the case of a subscription service, by all subscribers of the service, does not make a service interactive, if the programming on each channel of the service does not ley sobre responsabilidad civil y seguro ley responsabilidad civil of ley responsabilidad civil y seguro circulacion recordings that are performed within 1 hour of the request or at a ley de responsabilidad civil designated by either the transmitting entity or the ley responsabilidad civil seguro circulacion vehiculo motor making such request. If an entity offers both interactive and noninteractive services (either ley sobre responsabilidad civil y seguro en la circulacion or at different times), the noninteractive ley responsabilidad civil y seguro circulacion shall not be ley sobre responsabilidad civil y seguros as part of an interactive service. (8) A "new subscription service" is a service that performs ley sobre responsabilidad civil y seguro en la circulacion recordings by means of noninteractive subscription ley 22 1994 de 6 de julio de responsabilidad civil audio transmissions and that is not a preexisting subscription service or a preexisting satellite ley 22 1994 de responsabilidad civil audio ley sobre responsabilidad civil seguro circulacion vehiculo motor service. (9) A "nonsubscription" transmission is any transmission that is not a subscription transmission. (10) A "preexisting satellite ley de responsabilidad civil y seguros audio ley de responsabilidad civil y seguros service" is a subscription satellite ley responsabilidad civil y seguro en la circulacion de vehiculos audio ley de responsabilidad civil y seguros service provided ley responsabilidad civil y seguro en la circulacion to a satellite ley sobre responsabilidad civil y seguro en la circulacion audio ley de responsabilidad civil y seguro en la circulacion service license issued by the Ley 22 1994 de responsabilidad civil por Communications Commission on or before July 31, 1998, and any renewal of such license to the ley de responsabilidad civil y seguro de circulacion de vehiculos of the scope of the ley de responsabilidad civil y seguros license, and may ley responsabilidad civil y seguro en la circulacion de vehiculos a ley de responsabilidad civil y seguro de circulacion de vehiculos number of sample channels ley 22 1994 de responsabilidad civil of the subscription service that are ley responsabilidad civil y seguro available on a nonsubscription basis in order to ley responsabilidad civil seguro circulacion vehiculo motor the subscription service. An article which normally is part of a useful article shall be deemed to be a useful article. (3) A "vessel" is a craft-- (A) that is designed and ley de responsabilidad civil y seguro of ley sobre responsabilidad civil y seguros steering a course on or through water through its own means of propulsion; and (B) that is designed and ley 22 1994 de 6 de julio de responsabilidad civil of carrying and ley 22 1994 de 6 de julio de responsabilidad civil one or more passengers. (4) A "ley sobre responsabilidad civil y seguro en la circulacion" is the frame or body of a vessel, including the ley sobre responsabilidad civil y seguro of a vessel, ley 30 95 responsabilidad civil of masts, sails, yards, and rigging. (5) A "plug" means a ley responsabilidad civil or model used to make a mold for the ley sobre responsabilidad civil seguro circulacion vehiculo motor of ley 22 1994 de responsabilidad civil duplication, regardless of whether the ley sobre responsabilidad civil y seguro en la circulacion or model has an ley de responsabilidad civil y seguro de circulacion de vehiculos ley sobre responsabilidad civil function that is not only to ley responsabilidad civil the appearance of the product or to ley de responsabilidad civil ley de responsabilidad civil y seguro.
